PT Skorcard Teknologi Indonesia (hereinafter “Skorcard”, the “Company”, “We” or “Us” or “Our”) is a company providing convenience for our users (“User”, “You”, “Your”, “I”, “Me”) to have a credit card based on a co-branding partnership with Our Bank partners where the User can control the credit card completely through Our reliable Mayapada Skorcard application, from the registration process to card management (“Services”).

These Terms of Use should be read in conjunction with Our Privacy Policy. You understand and agree that these Terms of Use is part  and inseparable part of the Privacy Policy

This Terms of Use is made to govern the Services that We provide as defined below:

1. Definitions

Licensed User Access Information shall mean PIN, passwords, security questions and answers, logins and any other information that allows You to access the information and/or Services in the Skorcard Platforms.

User’s Account Data shall mean any data stored in Your account on Your network of financial services provider including without limitation bank, credit card, debit card, and deposit transactions.

Losses shall mean any losses, claims, damages, fault, malpractice, negligence, liabilities, obligations, penalties, judgments, arbitration awards, suits, proceedings, and investigation.

Services shall mean the services provided by Us to You through the Skorcard Platforms as as defined in initial paragraph of Terms of Use.

Payment Service Provider means a third-party payment service provider who cooperates with Us to process, transmit, and facilitate payment methods on the Skorcard Platform.

Skorcard Platform(s) shall mean any application, platform digital, website, social media, partner platforms, or any such other platform in any form maintained and operated by Us.

2. Services

(1) Eligibility of Receiving the Services

By registering with Skorcard and accessing the Skorcard Platform and Services, you are representing the following:
  1. You are 21 years of age or older
  2. You are capable of entering into a legally binding agreement
  3. You are not barred or otherwise legally prohibited from accessing or using the Skorcard Platform or its Services.
  4. You have provided complete and accurate information.
  5. You only apply for the Services for yourself.

(2) Credit Worthiness Assessment

Our Bank Partner will carry out checks to assess whether You are eligible to get our credit card. They will use various data in the checking process. These checks are carried out in accordance with procedures and applicable law. They may use third party services to carry out checks. They may also ask You to log in to Your banking application to verify Your financial information.

(3) Approval, Issuance and Activation

We will notify You if Your credit card is approved or rejected with the reason for the rejection. Once approved, We will issue a virtual card in an active state and followed by sending your physical card via courier in an inactive state. After receiving the physical card package, there is a QR Code inside. Scan the code using Your Skorcard mobile application and You can start the transaction.

(4) Personal Identification Number and Credit Card Management

You need to set a personal identification number (PIN) via the Skorcard Platform after receiving the card. Please keep Your PIN confidential and change it regularly. You can use the Skorcard Platform to access information or notifications related to cards, accounts, transactions, bills and other available features. We will always be able to update and add other features to the Skorcard Platform.

(5) Restriction

User’s use and access of Skorcard Platform is subject to any applicable restrictions that may be imposed by Skorcard from time to time, be it by amendment to this Terms of Use or any other policies that Skor Life is implementing in the future. We advise that You periodically read the latest version of this Terms of Use.

(6) Unauthorized Access

User is prohibited from sharing Licensed User Access Information, with any party, and shall prevent unauthorized access to the use of information, file, or data that You save or use in connection with the Services. You are solely responsible for any and all activities that occur under your account.

(7) Consent

You hereby agree to provide personal data, financial data, and any other that You have  to Our Bank partners in the form of transaction data, bank statement, and other important financial data as long as applicable laws and regulations allow.  You further agree to Us using Your data and information in connection with providing services to You via the Skorcard Platform in accordance with applicable laws and regulations.

3. Account and Data Deletion

You may delete Your account at any time and discontinuing the use of Services. By deleting your account, the legal relationship between You and Skorcard ends, but does not eliminate the obligations You had before deleting Your account.

4. Liability

Liability applicable for the provision of Services are as follows:
  1. User hereby agree to indemnify and hold harmless Skorcard, including but not limited to its shareholders, directors, commissioners, employees, and/or advisors, from and against any and all Losses in connection with the provision of Services.
  2. You agree to immediately notify Us if You become aware of any loss, theft, or unauthorized use of Licensed User Access Information. We are entitled to reject access to the Services (or any part of it) if We reasonably believe that you have suffered loss, theft or unauthorized usage of the Licensed User Access Information, to allow Us to rectify such matter. You hereby indemnify Us against any Losses in relation to such matter.
  3. You hereby acknowledge and agree that us, our Bank partner and third-party vendors shall have the authority to combine the User’s Account Data with data from other persons for data analytic purposes, view insights at the aggregate level such as seeing the average age of Skorcard Users, gender of Skorcard Users etc., to the extent permitted by laws and regulations. However, such data will not be directly identified to You or any individuals, for the purpose of certain analytical research, tracking of performance and comparison, and any other matters with the purpose of enhancing customer experience and Services, as well as solving problems and technical support.

5. Payment Service Provider Cooperation

We can cooperate with Payment Service Providers in facilitating payments made on the Skorcard Platform. By submitting Your payment information on the Skorcard Platform, You consent to Us providing that information to Payment Service Providers to facilitate payments. You acknowledge and understand that You may become subject to additional terms and conditions applicable to the relevant Payment Service Provider, and We advise You to review and examine the terms and conditions of the relevant Payment Service Provider. You acknowledge and understand that Payment Service Providers may experience unintended technical failures, problems or interruptions in forwarding, processing or transmitting payments made by You to Your bank account or electronic wallet account. In such circumstances, You agree and promise not to make any claim or claim against Us for, any and all damages and losses (including but not limited to loss of money, reputation, profits or other intangible losses) that may arise directly or indirectly due to the failure, problem or technical problem of the Payment Service Provider.

6. Prohibition 

You agree not to use, or attempt to use the Skorcard Platform for any purpose that is unlawful or prohibited by these Terms of Use or any applicable laws and regulations, including but not limited to:
  1. create and/or use any hardware, software, features, and/or other devices for the purpose of manipulating the Skorcard Platform system or making copies of the Skorcard Platform or part of the Skorcard Platform, including manipulation of (i) Content, (ii) crawling/ scraping); (iii) other activities that can reasonably be considered as manipulative actions against the Skorcard Platform system;
  2. abuse or interfere with the operation of the Skorcard Platform or the servers or networks connected to the Skorcard Platform, including installing, transmitting, transmitting, uploading, or otherwise making available any material that contains software viruses, worms, or other computer code, documents or programs designed to interfere with, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  3. collect or store personal data about other Skorcard Platform Users in connection with prohibited behavior and activities set out in these Terms of Use;
  4. impersonate any person or entity, falsely state or misrepresent Your affiliation with any person or entity;
  5. remove any copyright, trademark, or other intellectual property rights notices from the Skorcard Platform; and
  6. received unauthorized access to any part or feature of the Skorcard Platform, including taking any action that has a negative impact or causes inconvenience to other Users.

7. Governing Law and Dispute Resolution

  1. This Terms of Use and the provision of the Services are governed by and construed in accordance with the laws of Indonesia.
  2. The parties agree that in the event of any dispute, arising out of or in relation to this Terms of Use or its performance, the parties will attempt for a period of 30 (thirty) business days after the receipt of a notice by one of the Party from the other Party of the existence of the dispute, endeavor to settle the dispute amicably between the Parties.
  3. If within the period as stipulated above, the parties are unable to settle the dispute amicably, such dispute shall be referred to and settled by South Jakarta District Court.

8. Language

This Terms of Use is made in Indonesian and English. In the event of any inconsistency or different interpretation between the Indonesian and the English version, You agree that the Indonesian version will prevail to the extent of such inconsistency or conflict, and the relevant English version is deemed to be automatically amended to be consistent with the relevant part of the Indonesian version.

9. Severability

If any provision of this Terms of Use or the application thereof to any situation or circumstance shall be invalid or unenforceable, the remainder of this Terms of Use shall not be affected, and each remaining provisions shall be valid and enforceable to the fullest extent.

10. Entire Agreement

This Terms of Use constitutes the entire agreement between You and Skorcard with respect to the subject matter of these terms and conditions and supersede and replace any prior version of this Terms of Use.

You may be subject to additional terms and conditions when You use, purchase or access other services, affiliate services or third-party content or material.

11. Change of Terms of Use

We are entitled to change or supplement to the content of this Terms of Use from time to time with the prior notification of our Users via notification media no later than 30 (thirty) working days before the change takes effect, and any of such changes will be shown on this page. Changes to these Terms of Use are effective if there is no response from the User within 30 (thirty) working days after the notification above. In this case, if You continue to access and use the Skorcard Platform, You will agree to the changes and/or additions to the Terms of Use. If You do not agree to the changes and/or additions to the Terms of Use, You can stop using the Skorcard Platform.

12. Notification

We may send receipts, invoices, notifications, newsletters, promotions, alerts and other information through Your registered phone number and/or email address as well as through the Skorcard Platform. You may opt-out of receiving messages at any time by changing Your preferences and settings on Your account. You acknowledge that opting out of receiving messages may impact Your use of the Skorcard Platform. Certain messages relating to Our Service that we deemed necessary for You may not have ability to opt-out of.

USER CONSENT 

I have read, understood, and agreed the Terms of Use & Privacy Policy, where both documents constitute an integral and inseparable document. I also guarantee the accuracy of my personal data for further processing by VIDA as a Skorcard partner.
